These Terms of Service ("Terms") govern your use of the Command Shift platform and services operated at commandshiftai.com. By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

Command Shift provides AI-powered website analysis and AI employee installation services. Our platform uses artificial intelligence to analyze websites, generate performance reports, and deploy AI agents that automate business operations for our clients.

2. Account Terms

You must be at least 18 years old to use our services.
You must provide accurate and complete information when creating an account.
You are responsible for maintaining the security of your account and password.
You are responsible for all activity that occurs under your account.
You must notify us immediately at hello@commandshiftai.com if you become aware of any unauthorized use of your account.

3. Free Analyzer Tool

The free website analyzer tool available at /analyze is provided "as-is." Results are AI-generated and may not be 100% accurate. The analysis is intended to provide a general overview and should not be treated as definitive professional guidance. See our AI & Service Disclosures for more details.

4. Paid Services

Our AI employee installation services are priced at $2,000 for initial setup plus $500 per month for ongoing management and optimization. Specific pricing may vary based on scope and will be confirmed in writing before work begins.

Cancellation: Either party may cancel the ongoing monthly service with 30 days' written notice.
Refunds: Unused months will be refunded on a pro-rated basis. Setup fees are non-refundable once work has begun.
Payment: Invoices are due upon receipt unless otherwise agreed in writing.

6. Intellectual Property

Our platform: Command Shift owns all rights to the platform, its code, design, AI models, and proprietary processes.
Your data: You retain ownership of all data, content, and materials you provide to us. By using our services, you grant us a limited license to use your data solely to provide the services you requested.

7. API Keys & Third-Party Credentials

Some services may require you to provide your own third-party API keys. While we encrypt all API keys at rest using AES-256-GCM encryption, you acknowledge that:

You are responsible for the security and usage of your own API keys.
You accept the risk associated with providing credentials to any platform.
We make no guarantees regarding third-party service availability or security.
Usage charges from third-party APIs are your responsibility.

8. Limitation of Liability

To the maximum extent permitted by law, Command Shift and its owner, Christian McLeod, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our services.

Our total liability for any claim arising from your use of the services shall not exceed the total fees you have paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Command Shift, its owner, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use or misuse of the services, your violation of these Terms, or your violation of any third party's rights.

10. Termination

Either party may terminate the service agreement with 30 days' written notice.
We reserve the right to suspend or terminate your account immediately for abuse, violation of these Terms, or illegal activity.
Upon termination, your right to access the platform ceases. We may retain your data for a reasonable period for legal and operational purposes before deletion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. For material changes, we will notify you by email if you have an account. Continued use of the services after changes constitutes acceptance of the revised Terms.
